Categorical Exemptions and Zone Variance No. PZV 22-027 & Tentative Parcel Map No. PPM 22-013 to allow the adjustment of lines of two existing parcels into two parcels (APNs 030-050-022 and 030-050-023) and divide the resulting 19.76 +/- acre parcel into two parcels (1.18-acres Parcel No.1 and 18.58-acres Parcel No. 2), with a final parcel map waiver requested, in the AE-40 (Exclusive Agriculture – 40 Acre Minimum) Zone. Special Use Permit No. PSP 22-006

Certification and Adoption of the Final Supplemental Environmental Impact Report (Final SEIR), California Environmental Quality Act (CEQA) Findings of Fact, and Mitigation Monitoring and Reporting Plan (MMRP) for PSP 22-006 consistent with CEQA and the State CEQA Guidelines. Special Use Permit No. PSP 22-006 requests to allow a 500 megawatt-alternating current (“MW-AC”) utility-scale solar farm with up to 500 MW-AC of energy storage capacity on six (6) Assessor’s Parcel Numbers (“APNs”) encompassing approximately 1,200 acres of land located near the unincorporated community of Ducor, a census designated place, in south central Tulare County. Neighboring unincorporated communities include Terra Bella to the north and Richgrove to the southwest. The Rexford 2 Solar Farm Project (“Rexford 2” or “Project”) site is located in close proximity to the previously approved Rexford 1 Project (PSP 19-073), with two parcels being immediately adjacent to the Rexford 1 Project. Rexford 2 is intended to share some common facilities that are already approved for construction associated with the Rexford 1 Project. The majority of the Project site is comprised of active agricultural fields (actively tilled and commercially farmed grain fields, vineyards, and citrus orchards), fallow agricultural fields, and developed areas (roads, agricultural infrastructure). The Project site is surrounded by existing agricultural uses including vineyards, orchards, dry-land grain, irrigated crops, and grazing lands and scattered rural residences and agricultural related structures. The Project site is located west of State Route (SR) 65 and generally located north of Avenue 56, east of Road 200, south of Avenue 75, and west of Road 224. The Project site is located in the AE-20 (Exclusive Agricultural – 20 Acre Minimum) Zone and the AE-40 (Exclusive Agricultural – 40 Acre Minimum) Zone on APNs: 319-160-007; 320-360-005; 321-010-002 & -003; and 321-140-009 & -011.  Contact Aaron Bock at (559) 624-7000 or email at [email protected]  (TWO MOTIONS)
 
Approve: Certify and Adopt the Supplemental Environmental Impact Report, CEQA Findings of Fact, and Mitigation Monitoring Reporting Program for Special Use Permit No. PSP 22-006 as being in compliance with the California Environmental Quality Act (“CEQA”) and the CEQA Guidelines for the Implementation of the California Environmental Quality Act of 1970.

Amendment to the Goshen Community Plan, General Plan Amendment No. GPA 22-002 & Zone Change No. PZC 22-008 amending the land use from “Agriculture” to “Light Industrial” and to expand the Urban Development Boundary on 30 acres of two (2) 40-acre, split zoned, parcels and change the zoning from an AE-40 (Exclusive Agricultural – 40 acres minimum) to the M-1 (Light Manufacturing) zone. Approve: The Recommendation that the Board of Supervisors certify and adopt an Addendum to Goshen Environmental Impact Report, consistent with the California Environmental Quality Act (CEQA) and the State CEQA Guidelines pursuant to Title 14, Cal. Code Regulations, Section 15168.

Approve: The Recommendation that the Board of Supervisors approve General Plan Amendment No. GPA 22-002 to change the Land Use Designation from “Agriculture” to “Light Industrial”.

Approve: The Recommendation that the Board of Supervisors approve Change of Zone No. PZC 22-008, to change the Zone from the AE-40 (Exclusive Agricultural – 40 acres minimum) Zone to the M-1 (Light Manufacturing) Zone.

PROCEDURE FOR CONDUCT OF PUBLIC HEARINGS AND DISCUSSION ITEMS BY THE TULARE COUNTY PLANNING COMMISSION*

  1. Open for public hearing.
  2. Presentation of factual staff report and environmental finding.
  3. Public testimony -- proponent's presentation
  4. Public testimony -- opposition's presentation
NOTE:   To avoid cumulative and repetitious testimony, the Chair may restrict testimony or place time limits on presentations. Testimony and evidence must be germane to the topic of the hearing.
   
  1. Summation and/or rebuttal by applicant (at the discretion of the Chair, usually limited to five minutes.)
  2. Summation and/or rebuttal by opposition (at the discretion of the Chair, usually limited to five minutes.)
  3. Staff recommendation including reasons or criteria for choice.
  4. Close of public testimony phase of the hearing -- no additional testimony is taken following the staff recommendation unless rebuttal is specifically requested and such request is granted by the Chair.
  5. Discussion and decision by the Planning Commission -- final decision shall include reference to applicable criteria or ordinance bearing influence on the decision.
  6. Notification of date for Board of Supervisors' action (if applicable) and rights of appeal.
  7. Close of public hearing -- no further action is to be taken on the matter before the Commission. Any public hearing may be continued from time to time.

NOTE: Planning Commission actions are advisory for all General Plan Amendments, Zone Changes, Planned Unit Developments, and all subdivisions located outside urban areas. Such matters require final action by the Board of Supervisors. All Planning Commission actions are final on Special Use Permits, Zone Variances, Setback Variances, and Subdivisions within urban areas unless appealed to the Board of Supervisors. All Planning Commission actions on any of the above matters may be appealed to the Board of Supervisors. Any appeal must be filed in writing with the Board of Supervisors within 10 days and an appeals fee is required. *(Planning Commission Resolution No. 72.1, as amended by Resolution Nos. 4931 and 7392)
